🤝 Affiliate Agreement

This Agreement governs your participation in the Tribeca Curations affiliate program. By enrolling, you confirm that you have read it, that you are at least 18 years old, and that you agree to be bound by it.
1. Enrollment
Enrollment is free. We may accept or decline any application, and we may suspend or close an account at any time. You are an independent contractor, not our employee, agent or partner, and nothing here creates any of those relationships.
2. Your referral link
You will choose a referral code and receive links in the form
tribecacurations.com/?r=yourcode. When somebody follows one
of your links, we store a cookie in their browser for
30 days. If they place an order in that window, the
order is credited to you. Where more than one affiliate has referred the
same shopper, the most recent link wins.
You may not disguise, cloak, iframe or otherwise misrepresent your links, and you may not use URL shorteners in a way that hides that the destination is our store.
3. Commission
- You earn 5% of the product subtotal on qualifying orders.
- Commission is calculated on the price of the items only. It is not paid on shipping, taxes, gift wrapping or any other charge.
- Commission is held for 30 days after payment so that returns, refunds and chargebacks can settle. After that it becomes payable.
- Commission is void on any order that is cancelled, refunded, charged back, unpaid, fraudulent, or placed in breach of this Agreement.
- We may change the commission rate at any time. A change applies only to orders placed after it takes effect; orders already earned keep the rate they were placed at.
4. Payment
You may take payment as store credit or as cash. Store credit is issued as a single-use code and has no minimum. Cash payouts are made once your approved balance reaches $25.00, to the PayPal, Venmo or Cash App account you give us; balances below that roll forward.
You are responsible for all taxes on what you earn. If we pay you $600 or more in cash in a calendar year, United States law requires us to collect a Form W-9 from you and to report the payments on a Form 1099-NEC. We may withhold payment until we have a completed W-9. Store credit is a discount rather than income and is not reported.
5. Self-referral
You may not earn commission on your own purchases, or on purchases made by your household, on your behalf, or by any account you control. Orders placed with the email address on your affiliate account do not earn commission. This program rewards bringing new customers to the store, not discounting your own orders.
6. Promotion: what you may not do
These rules exist to protect the store's reputation, which is also what makes your links worth following. Breaching any of them voids commission and may close your account.
- Disclose the relationship. The United States Federal Trade Commission requires you to make it clear that you earn a commission. A plain statement such as “I earn a commission on purchases made through this link” must be visible near the link, not buried in a bio or behind a click. This is a legal obligation, not a preference.
- No spam. No unsolicited email, SMS, direct messages, forum posts, comment spam or messaging-app broadcasts. All email you send must comply with the CAN-SPAM Act.
- No paid search on our brand. You may not bid on “Tribeca Curations”, our brand names, our domain, or close misspellings of any of them, in Google Ads or any other advertising network. You may not point paid ads directly at our domain.
- No trademark misuse. You may not register domains, social accounts, or app names containing our name or a misspelling of it, and you may not present yourself as us or as an official store.
- No cookie stuffing. Referral links must be followed deliberately by a person. No automatic redirects, hidden iframes, pop-unders, forced clicks, adware, browser extensions or toolbars.
- No unauthorized coupons. You may not create, post or imply discount codes that we did not issue you, and you may not submit our brand to coupon or deal aggregators.
- No false claims about the products. These are confectionery and snack foods. You may not make health, dietary, medical, weight-loss or allergen claims about them. Do not describe any product as safe for a particular allergy; ingredients and manufacturing change without notice.
- No fake reviews or fabricated endorsements, and no bot, click-farm or incentivised traffic.
- No unlawful, hateful, sexually explicit or otherwise objectionable placement, and no promotion on any site directed at children under 13.
7. Our brand
You may use our name and logo only to link to our store, in unmodified form, and only while this Agreement is in force. We grant you no other license, and we may ask you to remove or change any use of them.
8. Suspension, withholding and termination
Either of us may end this Agreement at any time for any reason. If we believe an account has breached this Agreement or that its traffic is fraudulent, we may withhold unpaid commission, reverse commission already credited, and close the account. On termination, you must stop using your links, our name and our logo. Approved commission earned before termination that is not in dispute will be paid.
9. Liability
The program is provided as-is. To the fullest extent permitted by law, our total liability to you under this Agreement is limited to the commission payable to you in the three months before the claim arose. We are not liable for lost profit or for any indirect or consequential loss.
10. Changes and governing law
We may update this Agreement. Material changes take effect when a new version is published, and continuing in the program after that is acceptance of it. This Agreement is governed by the laws of the State of New York, and the courts of New York have exclusive jurisdiction.
